About these terms
These Terms and Conditions govern purchases from The Wizard Workshop and use of thewizardworkshop.ca. By checking the required policy acceptance box and submitting an order, you confirm that you have reviewed and agree to these Terms, the Refund and Returns Policy, and the Privacy Policy presented during checkout.
Nothing in these Terms limits a right or remedy that cannot legally be limited under applicable consumer-protection law.
Supplier information
The supplier and operating name is The Wizard Workshop.
Business address:
10-14 Cartier Court
Brockville, Ontario K6V 5S5
Canada
Email: merlin@thewizardworkshop.ca
Telephone: 613-556-1420 (text messages only)
The address above is provided for legal and transactional identification. It is not a general returns depot. Do not mail products there unless we specifically authorize a return and provide instructions.
Eligibility and customer information
You must have legal capacity to enter into a purchase agreement. You are responsible for providing accurate billing, shipping, contact, and order information and for reviewing the order before submitting it.
Contact us immediately if information is incorrect. We can voluntarily correct or cancel an order only before production begins. Statutory rights remain unaffected.
Products and made-to-order production
Products are made to order. Each product page will identify the item, available options, price, material details, and other information reasonably needed to make a purchase decision.
Screen settings and lighting may affect how colours appear. Minor colour differences that are inherent in screen display or the printing process do not change the product ordered. This does not excuse a damaged, defective, misprinted, materially inaccurate, or incorrect item.
We may correct an obvious description, image, availability, or pricing error before accepting an order. We will not substitute a materially different product without your express agreement.
Prices, currency, taxes, and shipping charges
All orders are charged in Canadian dollars. The website may show an approximate United States dollar value for convenience. Any USD display is an estimate only. Checkout returns to Canadian dollars, and your card issuer may apply its own exchange rate or fees.
Before you submit an order, checkout will show an itemized list of products, quantities, prices, shipping charges, applicable taxes, other applicable charges, and the total amount payable. We will not add a mandatory charge after you accept the order unless you expressly agree or the law requires it.
The Wizard Workshop is not currently registered to collect GST/HST. Any tax we are legally required to collect will be shown before you submit the order. Tax treatment may change if registration or collection becomes required. The amount shown at checkout when you submit the order governs that transaction, subject to correction of an obvious error before acceptance.
Shipping area and delivery
The store ships to eligible deliverable addresses in Canada and the United States. Canadian orders require a civic street address and cannot be shipped to post-office boxes. Checkout will reject recognized English and French PO-box formats entered for Canadian delivery. United States orders are accepted only where an available shipping method serves the entered address. An address outside Canada or the United States, or another unsupported address, cannot complete checkout.
Available delivery methods, shipping charges, and the promised or estimated delivery information will be shown before order submission and included in the order record where applicable. Delivery timing includes made-to-order production and carrier transit.
Tracking information will be provided when available. The carrier may be selected by our fulfilment provider, and carrier estimates are not guarantees unless we expressly identify a delivery date as promised. Remote and northern destinations may require additional transit time. Statutory rights concerning delayed delivery remain unaffected.
The Refund and Returns Policy explains how we handle confirmed loss, delayed delivery, and packages marked delivered but reported missing.
Order review, submission, and acceptance
Immediately before submitting an order, you will have an opportunity to review the products, quantities, options, delivery information, prices, charges, total, and these Terms, and to correct errors or decline the purchase.
Submitting an order is an offer to purchase. An automated screen or email acknowledging receipt does not by itself require us to accept an order. We accept the order when we send an order confirmation stating that the order has been accepted or when we begin production, whichever occurs first.
If we cannot accept an order, we will cancel it and refund any amount charged to the original payment method. Reasons may include unavailable production capacity, an unsupported delivery address, suspected fraud, a material pricing or description error, or a legal restriction.
We will send a retainable order confirmation or receipt to the email address provided at checkout. It will include or provide durable access to the required agreement information. This confirmation must be sent within the time required by applicable law.
Payment
Payment is processed in Canadian dollars through Square. Square handles payment-card information under its own terms and privacy notice. The Wizard Workshop does not intend to receive or store full payment-card numbers.
You authorize the total shown at checkout to be charged to the selected payment method. An order is not paid unless the payment is successfully authorized or completed.
Do not submit a payment method you are not authorized to use. We may use reasonable fraud-prevention checks and may decline or cancel a transaction when reasonably necessary, subject to applicable law.
Cancellations, returns, replacements, and refunds
Because each product is made to order, we do not offer discretionary returns or exchanges for change of mind, an incorrect selection, or other customer error.
Voluntary cancellation or correction is available only before production begins. Damaged, defective, misprinted, incorrect, lost, or delayed orders are handled under the Refund and Returns Policy.
The Refund and Returns Policy forms part of these Terms. If these Terms conflict with that policy about a cancellation, return, replacement, or refund, the provision that gives the customer the clearer or greater contractual protection applies. Statutory rights always prevail.
Website use
You may use the website only for lawful personal or business shopping and ordinary communication with The Wizard Workshop.
You must not:
- Attempt to gain unauthorized access to the website, accounts, systems, or data.
- Interfere with security, availability, checkout, or another person's use of the site.
- Introduce malicious code, automated abuse, fraudulent orders, or false payment information.
- Scrape, copy, reproduce, or commercially exploit site content except as permitted by law or with written permission.
- Use the site in a way that violates another person's rights or applicable law.
We may restrict abusive or unlawful access when reasonably necessary to protect customers, the business, or the website.
Intellectual property
Unless otherwise stated, The Wizard Workshop owns or is authorized to use the website's branding, artwork, photographs, text, graphics, layout, and other original content. Purchasing a product transfers ownership of that physical item after payment and delivery, but does not transfer copyright, trademark rights, reproduction rights, or other intellectual-property rights in its design or content.
Rights belonging to WooCommerce, Square, Printify, Duplium, carriers, and other third parties remain with their respective owners.
Availability and external services
We work to keep the website and checkout accurate and available, but temporary maintenance, technical faults, carrier interruptions, supplier interruptions, and events outside reasonable control may occur.
To the extent permitted by law, we are not responsible for a delay or failure caused solely by an event outside our reasonable control when we took reasonable steps to avoid or reduce its effects. This does not remove obligations or remedies that apply under consumer-protection law, including rights concerning late delivery, refunds, or misrepresentation.
Links to third-party websites are provided for convenience or required service information. Their content and practices are governed by their own terms and policies.
Liability
The Wizard Workshop remains responsible for obligations and remedies that cannot legally be excluded.
To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss that was not reasonably foreseeable when the agreement was made. Any limitation applies only to the extent it is lawful and fair in the circumstances.
Nothing in these Terms excludes liability for fraud, wilful misconduct, gross negligence, breach of a non-waivable statutory right, or any other liability that cannot legally be excluded or limited.
Privacy
Our Privacy Policy explains how personal information is collected, used, disclosed, retained, protected, and accessed. The policy forms part of the information provided with the purchase agreement but does not reduce rights under applicable privacy law.
Changes to these Terms
We may update these Terms for future website use and future orders. The version presented when an order is submitted governs that order unless both parties lawfully agree to a change or a change is required by law.
The published Terms will show their effective or last-updated date. We will not retroactively reduce an existing customer's contractual rights by posting a new version online.
Governing law and disputes
These Terms and purchases from The Wizard Workshop are governed by the laws of Ontario and the federal laws of Canada applicable there.
This governing-law provision does not deprive a consumer of mandatory rights or remedies available under the law that applies to them. Before starting formal proceedings, customers are encouraged to contact merlin@thewizardworkshop.ca so we can try to resolve the issue directly.
